PROPOSED ROAD CLOSURE AND SALE
TAKE NOTICE that, pursuant to Sections 34 of the Municipal Act, 2001, S.O. 2001, c. 25 and By-law 2008-22, the Council of The Corporation of the Town of Penetanguishene is declaring surplus a road allowance being the unopened lane between Polish Avenue and Wozniak Road on Plan 1712, former Township of Tay now in the Town of Penetanguishene, said unopened lane lying between 58 & 60 Polish Avenue and 57 and 61 Wozniak Road.
AND TAKE NOTICE that, at its meeting to be held on Wednesday, April 14, 2010 at 7:00 pm at the Council Chambers, Townhall, 10 Robert Street West, Council intends to pass a by-law to stop up and close the above noted road allowance and to authorize the sale of the lands to the adjacent property owner(s).
The purpose of the road closure and sale is to provide for lot additions through the future sale of the east half of the closed road allowance to 58 and/or 60 Polish Avenue, and of the west half of the closed road allowance to the owner(s) of 57 and/or 61 Wozniak Road. The purchasers will be responsible for all costs associated with the closure, including, but not limited to; survey costs; land valuation costs; advertising costs; land transfer costs; and legal costs. The purchaser will compensate the Town at market value for the land, as determined by the Town’s agent in this matter.
A key map showing the road allowance to be stopped up, closed, and sold is on file and may be examined at the Town Office at 10 Robert Street West, Penetanguishene, Ontario, during regular business hours. AND TAKE FURTHER NOTICE that persons interested in making representations on this matter must submit, in writing, to the attention of the Chief Administrative Officer by not later than 12:00 p.m. on Wednesday, March 31, 2010.
